By using our website, submitting an enquiry, accepting a quote or instructing us to proceed, you agree to these Terms and Conditions. If we sign a separate building contract with you, that contract prevails to the extent of any inconsistency.

Quotes are generally valid for 30 days unless stated otherwise.
Pricing may change due to market conditions, supplier increases, scope changes, latent conditions, council requirements or engineering changes.

Deposits and staged progress payments are required as set out in our quote or your building contract.
Invoices are payable within 5 business days unless otherwise agreed.
If payment is late, we may suspend works until accounts are brought up to date.
Building approvals, certifications and other authority consents may be required. We can assist with applications, or you may appoint your own consultant.
Works are performed in accordance with applicable laws, codes and standards. Where you provide plans or specifications, you are responsible for their accuracy and suitability unless we expressly agree otherwise.
You agree to provide safe and reasonable access to the site during normal working hours.
You warrant the site is free from hazardous materials and underground services not disclosed to us.
Delays caused by weather, authority inspections, site conditions, supply issues or events outside our control may extend the project.
We may engage qualified subcontractors to deliver parts of the works.
If a specified product becomes unavailable, we may propose a comparable substitute of similar quality and performance for your approval.
Your rights under the Australian Consumer Law (ACL) apply and cannot be excluded.
In addition to any statutory warranties, we warrant that our work will be carried out with due care and skill and in accordance with the plans and specifications agreed with you.
A defects liability period applies as set out in your building contract. Notify us in writing of any defects and we will assess and rectify within a reasonable time.
To the maximum extent permitted by law and subject to the ACL, our liability for any loss arising from the services is limited to re-supplying the services or paying the cost of having the services supplied again.
We are not liable for indirect or consequential loss, loss of profit or loss of opportunity.
Nothing in these Terms limits liability for negligence causing personal injury, or other liability that cannot be limited by law.
Provide accurate information, timely decisions and selections when requested.
Maintain appropriate insurances for your property as advised by your insurer.
Do not instruct trades on site directly. All directions should go through Purcell Homes.
If you cancel before work starts, reasonable costs incurred to date (design, engineering, approvals, ordering fees) may be payable.
If you materially breach these Terms or your building contract and fail to remedy within a reasonable time after notice, we may suspend or terminate works and invoice for work completed and costs incurred.
We are not responsible for delays or failure to perform due to events beyond our reasonable control, including severe weather, supply chain disruption, industrial action, government action or epidemics.
We handle personal information in accordance with our Privacy Policy. By contacting us, you consent to us using your details to respond and manage your project.
We may update these Terms from time to time. The version published on our website at the time of your acceptance will apply to your engagement unless otherwise agreed in writing.
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
